These Website Terms of Service (the “Terms”) govern your use of thespateam.com and any related websites, apps, and online services operated by Snake River Pool & Spa (collectively, the “Services”). Please read them carefully.

1. Acceptance of these Terms

By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

2. Who we are

The Services are operated by Snake River Pool and Spa, LLC, doing business as Snake River Pool & Spa and The Spa Team (“SRPS,” “we,” “us,” or “our”), 1340 S Orchard St, Boise, ID 83705, United States.

3. Use of the Services

You may use the Services for lawful, personal, and non-commercial purposes. You agree not to:

• Use the Services in any way that violates applicable law or the rights of others;
• Attempt to gain unauthorized access to the Services, our systems, or other users’ information;
• Interfere with or disrupt the Services, including by introducing malware or using automated tools to scrape, overload, or harvest data;
• Submit false, misleading, or fraudulent information; or
• Copy, resell, or exploit any part of the Services without our written permission.

We may suspend or restrict access to the Services at any time if we believe these Terms have been violated.

4. Product information, pricing, and availability

We work to keep product descriptions, images, specifications, pricing, and availability on the Services accurate and current. However, information may change without notice, and errors may occur. Colors and finishes may look different on your screen than in person. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time, including after an inquiry or order has been submitted.

Product availability is not guaranteed. Final pricing, availability, delivery, installation, warranty, and any other terms of a purchase are confirmed in writing by our team at the time of sale, and the terms in your written sales agreement or in-store purchase documents apply.

5. Promotions and events

Sales, promotions, giveaways, games, and events are subject to their own posted terms, dates, and eligibility requirements, which apply in addition to these Terms. Unless stated otherwise, promotions cannot be combined with other offers and may be changed or ended as described in their posted terms.

6. Online orders and pickup

Where the Services allow you to place an order or request a product online, your order is an offer to purchase. We may accept or decline it, for example if a product is unavailable or a pricing error occurred, and will contact you if there is a problem. Payment information is handled by our payment processors. Pickup, delivery, return, and exchange details are confirmed by our team for each order.

7. Forms, submissions, and communications

When you submit a form, request a quote, book service, chat with us, or otherwise contact us through the Services, you agree to provide accurate information. We handle the information you submit as described in our Privacy Policy. If you send us feedback, ideas, reviews, or other content, you grant us a non-exclusive, royalty-free right to use it in connection with our business, and you confirm you have the right to share it.

8. Text messages (SMS/MMS)

If you opt in to receive text messages from us, our SMS/MMS Terms of Service apply to that program. Consent to receive text messages is not a condition of purchase, and you can opt out at any time by replying STOP.

9. Third-party links and services

The Services may link to or include features from third parties, such as manufacturer websites, maps, payment processors, chat tools, social media platforms, and review sites. We do not control and are not responsible for third-party websites or services, and your use of them is governed by their own terms and privacy policies.

10. Google sign-in and Google user data

Some Snake River Pool & Spa apps and integrations may let you sign in with, or connect, your Google account. When you do, you authorize us to access only the Google account information and permissions shown on the Google consent screen. Snake River Pool & Spa apps and integrations that use Google sign-in only use the data needed to provide the requested feature.

Our use of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements, and is described in our Privacy Policy. You can revoke our access at any time from your Google Account settings at myaccount.google.com/permissions.

11. Intellectual property

The Services and their content, including text, graphics, logos, images, video, audio, games, and software, are owned by or licensed to Snake River Pool & Spa and are protected by copyright, trademark, and other laws. Third-party product names and trademarks belong to their respective owners. You may view and print content for your personal, non-commercial use, but you may not copy, modify, distribute, or create derivative works without our written permission.

12. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components. Content on the Services, including water care, maintenance, and product guidance, is for general information only and does not replace manufacturer instructions, product labels, or advice from a qualified professional. Product warranties, if any, are provided by the manufacturer or as stated in your purchase documents.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SNAKE RIVER POOL & SPA AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you. Nothing in these Terms limits any rights you have under a written purchase agreement or that cannot be limited by law.

14. Indemnity

You agree to indemnify and hold harmless Snake River Pool & Spa and its owners, employees, and agents from any claims, losses, liabilities, and expenses, including reasonable attorneys’ fees, arising out of your misuse of the Services or your violation of these Terms or applicable law.

15. Governing law

These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Services will be brought in the state or federal courts located in Ada County, Idaho, and you consent to the jurisdiction of those courts.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will post the updated version on this page and change the “Last updated” date above. Your continued use of the Services after changes are posted means you accept the updated Terms.
